The Divorce Process
The divorce process can be complicated even when both parties consent to
dissolve their marriage. You may think you can handle the legal side of
a divorce by yourself, but in doing so you may face numerous pitfalls
with lasting consequences. A Paoli family lawyer can help you understand
your rights and avoid easy-to-make mistakes, while simultaneously advocating
on behalf of your best interest.
The divorce process generally goes as follows:
- One spouse files a complaint for divorce and serves the complaint
- There is a waiting period before the parties can file their consents to
the divorce or seek a unilateral (no-fault) divorce
- Either spouse may raise economic claims in the divorce action
- Each spouse is entitled to conduct discovery to obtain financial information
from the other side
- Either spouse may seek interim relief on certain exigent economic claims
- If the parties cannot agree on their economic claims, one party must file
a motion to appoint the master
- The master will then hold conferences to attempt to reach a resolution
of the parties’ claims and, in the absence of an agreement, schedule
the matter for trial
- Either party may file exceptions to the Master’s recommendation after
a hearing and argument will be held before a judge
- After the parties’ economic claims are resolved by agreement or a
court determination, the final divorce decree will be entered
While this is the most common route of divorce, I understand that there
is no one-size-fits-all solution to any family matter. In certain situations,
the couple may be more concerned with privacy and working together to
solve issues, and in this case mediation could be right for you. Conversely,
if the parties wish to avoid the delays and costs associated with litigation,
arbitration is another option.
